CLRA Act Applicability- PAN INDIA

 

In India, the employment of contract employees is governed by the Contract Labour (Regulation and Abolition) Act, 1970 (often known as the CLRA Act) and the CLRA Act’s applicability differs amongst Indian states.

 

The primary goals of the act are to safeguard the rights of contract workers and make sure they have decent working conditions and pay. The act also tries to stop employers and contractors from abusing contract workers.

 

The act mandates that companies give contract workers access to first aid stations, bathrooms, and canteen facilities as a matter of course. Additionally, contract workers must receive the same compensation as regular employees for equivalent tasks from their employers.

 

In certain instances, such as when the work performed by contract labourers is of a perpetual nature and when the activity is directly tied to the establishment’s main line of business, the act provides for the elimination of contract labour.

 

The Contract Labour (Regulation and Abolition) Act, 1970 is a significant piece of Indian legislation that aims to safeguard the rights of contract workers and ensure that they are treated fairly at work.

 

There are two kinds of registrations in the Contract Labour (Regulation and Abolition) Act, 1970 –

  1. Principal Employer Registration
  2. Contractor’s Licence

At every establishment when contract employees exceed the prescribed limit, Principal Employer needs to take a registration Certificate from labour department and based on Registration Certificate received by the Principal Employer, eligible Contractors need to take the licence.
