The Delhi Shops and Establishments Act,1954

 

It is State specific Act that regulates the working conditions of employees working in Shops and Establishments and other businesses under the jurisdiction of Delhi State. Every Shop/Establishment require to take Shop and Establishment Registration in Delhi within 30 days of starting operation. Failure to register results in a fine and penalty. Labour Department of Delhi is the regulating authority.

 

This act covers provisions of working hours, wages, leave entitlements, holidays, overtime, and other conditions for the employees.

 

Delhi Govt. also implemented the rules related to the The Delhi Shops and Establishments Act,1954 called The Delhi Shops and Establishments Rules,1954

 

Applicability of Shop Registration in Delhi

 

Applicability of Shop registration in Delhi is not dependent on the number of employees. It applies to all kinds of Shops and establishments operating under the jurisdictions of Delhi State except the shops and establishments exempted through notification.

 

Key Provisions of the Act

 

1. Working Hours- No employee is allowed to work more than nine hours on any day and 48 hours on any week.
2. Restriction on double employment-No employee is allowed to work in two or more establishments at the same time.
3. The interval for rest and meals- No employee is allowed to work continuously for more than 5 hours on any day. On or before 5 hours, the employee needs to take half an hour of rest and meal intervals.
4. Overtime- An employee can do a maximum of 6 hours in a week and 150 hours in a year. The overtime rate shall be double the hourly rate.
5. Leaves- Every employee is entitled to leaves as follows-

(i) Sick Leave- 12 days

(ii) Casual Leave-12 days

(iii) Earned Leave-20 days (5 after 4 months of continuous service and 15 after 12 months of continuous service)

 

There is no carry forward of Sick and Casual leave. Only Earned leave can be carried forward a maximum of 45 leaves.
